These rules were approved by both the Road and Recreation Association and the Water and Sewer Association on October 15, 2003.
Appeals & disputes policy and procedure
- Under the appeal and dispute provisions of the bylaws, the Association keeps an appeal form (the “NOA form”) for any member appealing an action or decision of an agent of the Association. An appeal is accepted only if the action directly affects the appellant’s property or rights. The appellant and staff will make a reasonable effort to resolve the appeal before it goes to the Board; if it does, staff will attach a summary of the preceding events.
- To dispute the Board’s decision on an appeal, submit the appeal form, any additional clarification, a written statement of your choice to dispute the decision, and a list of up to 15 participants who will support your position at the Dispute Hearing.
- The person disputing chooses whether the hearing is open or closed. At an open hearing, only listed participants may take part.
- Notice of the Dispute Hearing, including whether it is open or closed, will be posted publicly at least 5 days in advance.
- A quorum of the Board decides any continuance or rescheduling of the hearing.
- A director’s unexcused absence from a Dispute Hearing counts as an unexcused absence from a regular Board meeting.
- A director’s documented conflict of interest is recorded as an excused absence.
- No director may file an appeal against their own Association.
